Abstract: | Um indivíduo que comete um crime no Brasil, após ser condenado por uma sentença definitiva, tem suspenso o seu direito de votar em eleições, plebiscitos e referendos. Este efeito da condenação decorre da interpretação prevalente no Supremo Tribunal Federal, voltada a uma exegese literal, acerca da norma constitucional que disciplina a suspensão de direitos políticos em tal hipótese. Diante do que este entendimento implica para a legitimidade da representação democrática e para a ausência de políticas públicas direcionadas à população carcerária, este estudo busca a análise de sua juridicidade. Assim, examina-se as diversas categorias de direitos políticos e de sua natureza, bem como a adequação do alijamento político do delinquente com a principiologia penal aplicável, buscando o aprofundamento de outras técnicas hermenêuticas para a abstração do sentido da norma constitucional sob análise. A partir de uma interpretação mais consentânea com tais parâmetros, avalia-se a suspensão de direitos políticos em algumas hipóteses específicas, assim como se procede ao cotejo com a análise da alistabilidade do condenado em alguns importantes casos no Direito Comparado, vislumbrando-se ainda a operacionalidade da efetivação da hipótese de preservação do direito de voto do apenado. |
Abstract: | A person who commits a crime in Brazil, after being convicted of a final judgment, has suspended his right to vote in elections and referendums. This effect of the condemnation derives from the prevailing interpretation in the Federal Supreme Court, directed to a literal exegesis, about the constitutional norm that regulates the suspension of political rights in this hypothesis. Given what this understanding implies for the legitimacy of democratic representation and the absence of public policies directed to the prison population, this study seeks to analyze its legality. Thus, it examines the various categories of political rights and their nature, as well as the adequacy of the delinquent's political suppression with the applicable penal principle, aiming at the deepening of other hermeneutic techniques for the abstraction of the meaning of the constitutional norm analyzed. From a more consistent interpretation of these parameters, the suspension of political rights is evaluated in some specific hypotheses, as well as the comparison with the active electoral capacity of the condemned in some important cases in Comparative Law, and also anticipating the execution of the hypothesis of preservation of the voting rights of the convicted. |
