| Abstract: | Busca-se, através da análise da crítica de Barbara Fried aos não consequencialistas, averiguar se a teoria de Keating relativa à distribuição equitativa dos resultados das atividades potencialmente danosas é capaz de responder a questões que as demais teorias morais da responsabilidade civil falham em responder. Analisa-se, portanto, se o contratualismo de Keating pode sugerir uma saída não consequencialista e não agregativa à questão proposta por Fried acerca de quais riscos os indivíduos têm direito de impor aos demais. Uma vez superada a barreira apresentada por Fried, o trabalho se dedica a analisar a influência da ideia de equidade na responsabilidade civil, destacada por Keating, e de que maneira esse conceito se apresenta decisivo na escolha entre os esquemas de responsabilidade civil presentes na cultura política. |
| Abstract: | The research, through Barbara Fried's critique to non-consequentialists, seeks to ascertain whether Keating's theory of fair distribution of risk and harm can answer questions that other moral theories of tort law fail to answer. It is examined whether Keating's contractualism may suggest a non-consequentialist, non-aggregative way to the question proposed by Fried regarding the risks citizens have the right to impose on others. Once the barrier presented by Fried was overcome, the work is dedicated to analyzing the influence of the idea of fairness in tort law, as highlighted by Keating, and how this concept is decisive in the choice between tort law schemes present in political culture. |
