Abstract: | A presente dissertação pretende investigar a maneira como o Supremo Tribunal Federal vêm se pronunciando em casos que têm por objeto a aplicação do princípio da liberdade de imprensa. Uma leitura superficial de seus julgados poderia levar o leitor a interpretar que as cortes superiores adotariam a teoria da ponderação de princípios de Alexy para resolver casos em que os referidos princípios colidem. Pretende-se demonstrar, contudo, que essa teoria não seria devidamente aplicada e que, caso o fosse, não seria essa a melhor escolha de método hermenêutico para a tarefa. O que se propõe é fazer uma releitura dos julgados do STF a partir da teoria da integridade de Ronald Dworkin, que parte da noção de adequabilidade dos princípios para que se chegue a uma resposta correta para cada caso concreto. Assim, pretende-se jogar uma nova luz sobre uma questão tão importante para o paradigma em que vivemos, dada a relação estreita entre o princípio da liberdade de imprensa com a própria democracia. |
Abstract: | This dissertation intends to investigate the way the Federal Supreme Court has been ruling in cases that have as object the application of the principle of freedom of the press. A cursory reading of his judgments could lead the reader to interpret that the highest court in Brasil would adopt Alexy's theory of principle weighting to solve cases where those principles collide. It is intended, however, to demonstrate that this theory would not be properly applied and that if it were, this would not be the best choice of hermeneutic method for the task. The purpose is to re-read the judgments of the Supreme Court based on Ronald Dworkin's theory of integrity, which starts from the notion of adequacy of principles to arrive at a correct answer for each specific case. Thus, it is intended to shed a new light on such an important issue for the paradigm we live in, given the close relationship between the principle of freedom of the press and democracy itself. |
