| Abstract: | O objetivo deste artigo é demonstrar que, no contexto da União Europeia, a liberdade da mídia é indissociável do conceito do pluralismo. Para isto, selecionaram-se documentos e casos do Tribunal Europeu dos Direitos Humanos que tratam, direta ou indiretamente, esta questão. Apesar de este conceito estar sempre em disputa, sua força normativa é indiscutível, tendo sido abordado tanto em normativas do bloco europeu quanto em decisões oriundas do Tribunal Europeu dos Direitos Humanos que tratam do âmbito normativo da liberdade da mídia. Conclui-se que, na União Europeia, democracia, liberdade e pluralismo da mídia são conceitos inseparáveis, pressupondo-se em constitutiva tensão. |
| Abstract: | The aim of this article is to demonstrate that in the context of the European Union, freedom of the media is inseparable from the concept of pluralism. We have selected documents and cases from the European Court of Human Rights that deal directly or indirectly with this issue. Although this concept is always in dispute, its normative force is indisputable and it is made evident both in norms of the European bloc and in the decisions of the European Court of Human Rights, which address the normative scope of the freedom of the media. It is concluded that in the European Union, democracy, freedom and pluralism of the media are inseparable concepts, which assume a constitutive tension. |
