| Abstract: | O presente artigo analisa o incidente de resolução de demandas repetitivas previsto no Código de Processo Civil. O objetivo do estudo é realizar uma análise comparativa entre o novo instituto e os mecanismos aparentemente semelhantes da Alemanha e do Reino Unido, de modo a avaliar os possíveis impactos para as garantias constitucionais já consagradas, com destaque para o contraditório. |
| Abstract: | This article analyzes the mechanism for judgment of repetitive lawsuits provided in Brazilian civil procedure code. The purpose of the study is perform a comparative analysis between the new institute and similar experiences in Germany and United Kingdom in order to evaluate the possible impacts for constitutional guarantees, with special reference to the right to contradiction and full defense. |
