| Abstract: | O artigo procura apresentar novo conceito de organização do trabalho para fins penais. A evolução do conceito baseada na jurisprudência do STF será analisada, assim como se há necessidade de que os trabalhadores sejam atingidos, individual ou coletivamente, para que se caracterizem os crimes previstos no título IV da Parte Especial do Código Penal. O artigo conclui que compete à Justiça Federal processar e julgar os crimes contra a organização do trabalho, previstos no código penal, tendo em vista o conceito proposto para o bem jurídico na atualidade. |
| Abstract: | The article presents new definition of “organization of labor” for criminal purposes. The evolution of the definition based on Brazilian jurisprudence will be analyzed. We will also look at the differences between when the victim is an individual compared to a group, under Title IV of the Special Part of the Penal Code. The article concludes that trials for crimes involving the organization of labor are under federal jurisdiction, according to the current definition. |
