| Abstract: | Examina-se neste artigo a disputa judicial entre a República da Costa Rica e a República da Nicarágua, referente ao livre exercício de navegação no rio San Juan. Analisa-se como a Corte Internacional de Justiça aplicou o direito ao caso concreto, estabelecendo medidas equânimes para solucionar a contenda. A justificativa reside na importância da sentença proferida, que concluiu pela necessidade de obediência dos signatários aos pactos previamente firmados, como regra basilar do Direito Internacional. A metodologia baseou-se em estudos relacionados ao tema, alicerces teóricos para alcançar as reflexões finais. |
| Abstract: | This article examines the judicial dispute between the Republic of Costa Rica and the Republic of Nicaragua concerning the free exercise of navigation on the San Juan River. It is analyzed how the International Court of Justice applied the right to the concrete case, establishing equitable measures to resolve the dispute. The justification lies in the importance of the sentence, which concluded that the signatories must obey the previously signed pacts, as a basic rule of international law. The methodology was based on studies related to the theme, theoretical foundations to reach the final reflections. |
