| Abstract: | Trata-se de trabalho voltado à verificação da permeabilidade das principais teorias da participação frente ao direito brasileiro, e que parte do reconhecimento de um déficit de fundamentação particular, referido a determinadas hipóteses de instigação e auxílio psíquico, que não encontram resposta satisfatória na explicação corrente, extraída da posição francamente majoritária na doutrina e jurisprudência. O trabalho volta-se, então, ao exame da viabilidade de respostas outras, ainda com os olhos atentos à legislação nacional e especialmente orientado ao problema da causalidade da participação, que, ao final, pretende se demonstrar contornado diante da solução apresentada. |
| Abstract: | This work is aimed at verifying the permeability of the main theories of participation in Brazilian law, and which starts from the recognition of a deficit of particular foundation, referring to certain hypotheses of instigation and psychic assistance, which do not find a satisfactory answer in the current explanation, drawn from the frankly majority position in doctrine and jurisprudence. The paper then turns to the examination of the feasibility of other answers, still with an eye on national legislation and especially oriented to the problem of causality of participation, which, in the end, intends to show itself circumvented by the presented solution. |
