dc.description.abstract | This dissertation aimed to problematize and investigate the application of artificial intelligence (AI) mechanisms in the Judiciary, from the perspective of access to justice, essentially through the way of the rights. The research work carried out examined the integration processes of mechanisms incorporated by data and computational algorithms in the judicial sector and its application in courts across the country. It was argued that machine learning, if applied to the Judiciary, considering the risks of its implementation, tends to exponentiate a strong instrument for matching the three dimensions of access to justice through the way of the rights, as elaborated by Avritzer, Marona and Gomes (2014), namely: (I) equal access to the judicial system; II) guarantee of the effectiveness of the rights, through information about these rights, making it possible to understand what rights the subject has and identify what mechanisms the justice system has to offer him; and (III) the possibility of participating in shaping the law itself, based on the identification of new categories of law. Throughout the work, it was found that AI models, when not properly structured, can stigmatize individuals into categories and drive alienation of entire groups, preventing access to rights and opportunities, as clarified by O'Neil (2020), while that, as stated by Rodrigues (2021), if restricted to functions of an operational and instrumental nature, the use of the mechanisms in question is fertile and deserves to be expanded. | pt_BR |
dc.description.resumo | A presente dissertação objetivou problematizar e investigar a aplicação de mecanismos de inteligência artificial (IA) no Poder Judiciário, a partir da perspectiva do acesso à justiça, essencialmente pela via dos direitos. O trabalho de investigação desenvolvido examinou os processos de integração de mecanismos incorporados por dados e algoritmos computacionais no setor judicial e sua aplicação nos tribunais pelo país. Defendeu-se que o aprendizado de máquina, se aplicado ao Poder Judiciário, considerando os riscos de sua implementação, tende a exponenciar um forte instrumento de correspondência das três dimensões do acesso à justiça pela via dos direitos, tal qual elaborado por Avritzer, Marona e Gomes (2014), quais sejam: (I) igualdade de acesso ao sistema judicial; II) garantia da efetividade dos direitos, por meio da informação acerca desses direitos, possibilitando a compreensão sobre quais direitos o sujeito possui e identificar quais mecanismos o sistema de justiça tem a lhe oferecer; e (III) possibilidade de participação na conformação do próprio direito, a partir da identificação de novas categorias de direito. Ao longo do trabalho, constatou-se que os modelos de IA, quando não devidamente estruturados, podem estigmatizar indivíduos em categorias e impulsionar alienações de grupos inteiros, impedindo o acesso a direitos e oportunidades, conforme esclarece O’Neil (2020), ao passo que, como afirma Rodrigues (2021), se restrito às funções de natureza operacional e instrumental, o emprego dos mecanismos em questão é fértil e merece ser expandido. | pt_BR |
