| Abstract: | A doutrina brasileira da efetividade taxou o passado como insincero ou desimportante, e na tentativa de superá-lo, instituiu na Constituição de 1988 um modelo radical de constitucionalismo normativo de forte concentração na figura do Supremo Tribunal Federal. O trabalho desenvolve contranarrativa que visa desconstruir o “mito da insinceridade normativa”, a partir do reconhecimento de traços da formação histórica do pensamento constitucional brasileiro, e afirma que a doutrina da efetividade construiu uma representação incorreta da realidade historiográfica do país. A reconstrução das tradições do constitucionalismo brasileiro demonstra que todas se realizaram e, de alguma maneira, ainda se realizam no ideário e na vida jurídica. Ao fim, explora o problema da eficácia e legitimidade no constitucionalismo normativo e demonstra que, acaso não reconheça a importância da história, será a doutrina da efetividade a repetir o mito que ela mesma construiu. |
| Abstract: | The Brazilian doctrine of effectiveness branded the past as insincere or unimportant, and in its attempt to overcome it, instituted in the 1988 Constitution a radical model of legal constitutionalism with strong concentration on the figure of the Federal Supreme Court. The essay develops a counternarrative that seeks to deconstruct the “myth of normative insincerity” and affirms that the doctrine of effectiveness has constructed an incorrect representation of the country's historiographical reality. The reconstruction of the traditions of the brazilian constitutionalism demonstrates that all have achieved and, in some way, still take place in theideals and legal life. In the end, it explores the problem of efficacy and legitimacy in legal constitutionalism and demonstrates that, if it does not recognize the importance of history, it will be the doctrine of effectiveness to repeat the myth it has constructed. |
