Abstract: | O presente trabalho busca investigar em que consiste o fenômeno das fake news para afastar seus efeitos nocivos sobre o processo eleitoral. Na falta de uma definição legal precisa, reputa-se bastante complexo tentar proibir aquilo que não se consegue conceituar. O risco de adotar definições muito amplas pode caracterizar ameaças à liberdade de expressão e de informação, o que pode comprometer a própria democracia, dado o risco de o Estado se converter em um órgão censor. Para tanto, é preciso compreender em que medida o discurso no âmbito da propaganda eleitoral deve ser protegido e quando não o deve ser. Defende-se que os mecanismos jurídicos atualmente disponíveis no ordenamento pátrio são suficientes para combater as fake news e que o excesso de regulamentação gera mais riscos do que ganhos à democracia que se pretende proteger. A real transformação depende de políticas de educação midiática que empoderem o indivíduo e a sociedade civil. |
Abstract: | This work seeks to investigate the fake news phenomenon to prevent its harmful effects on the electoral process. In the absence of a precise legal definition, it is considered quite complex to try to prohibit what cannot be conceptualized. The risk of adopting very broad definitions can threat the freedom of expression and information, which can compromise democracy itself, given the risk of the State becoming a censorship body. Therefore, it is necessary to understand to what extent the speech in the context of electoral campaign should be protected and when it should not be. It is argued that the legal mechanisms currently available in the national order are sufficient to counter fake news and that excessive regulation generates more risks than gains for the democracy that is supposed to be protected. The real transformation depends on media literacy policies that empower the individual and civil society. |
