Abstract: | O Consenso de Washington sumarizou em 1989 diretrizes político-econômicas que já regiam a economia global desde a década de 1970 e que persistem até hoje, em maior ou menor grau, nos países em desenvolvimento. Tais diretrizes são incompatíveis com os fundamentos, fins e objetivos do Estado Democrático de Direito e do constitucionalismo contemporâneo. O Estado, contrariando o constitucionalismo democrático, tem operado segundo uma lógica de “socialização dos riscos e privatização das recompensas”. Preconiza-se o controle jurídico da economia de modo que o Estado passe a operar segundo uma lógica de distribuição proporcional dos riscos e benefícios e de inclusão social, em substituição à busca exclusiva por crescimento econômico, de modo a se realizarem as disposições constitucionais, no caso brasileiro, bem como o direito dos povos e do cidadão ao desenvolvimento, de modo global. |
Abstract: | In 1989 the Washington Consensus summarized global economic policies that have been governing the global economy since the 1970’s that persevere to this day, to a greater or a lesser extent, in developing countries. This establishment is incompatible with the foundations, ends and objectives of the democratic rule of law and the contemporary constitutionalism. Contradicting democratic constitutionalism, the State is governed according to the logic of “socialization of risks and privatization of rewards”. Legal control of the economy is advocated so that the State starts to operate according to a logic of proportional distribution of risks and benefits and social inclusion, replacing the quest to economic growth exclusively, in order to effectuate the constitutional dispositions, in the Brazilian case, as well as the right of peoples and citizens to development, globally. |
