| Abstract: | Tendo como referenciais teóricos autores cujo pensamento encontra-se no eixo radical da filosofia política de fronteira tais como Walter Benjamin e Giorgio Agamben buscou-se apontar como se daria o papel do direito, entendido como vida ordenada em comum, em um estado de exceção efetivo. Trata-se de uma investigação teórica que tem em vista pensar a ação política para além do Estado e do direito, esferas que atualmente mantêm-se como monopólios de sua legitimação. Para tanto, buscou-se pensar se seria possível conceber um direito desvinculado da violência nômica, bem como desativado das dicotomias que o dividem em ser e dever-ser. As conclusões apontam para a possibilidade de uma forma-devida e de um uso comum, além de para novos usos do direito. |
| Abstract: | Based on authors whose thoughts are situated on the radical axis of the political philosophy of frontier as Walter Benjamin and Giorgio Agamben it attempted to point out how would be the role of the law, which is understood as ordered life in common, in a real state of exception. This work is a theoretical investigation that aims to think of political action beyond the state and law, spheres that remain as monopoly of its legitimation. Therefore, it was intended to think whether it would be possible to conceive a law not linked to the nomic violence, as well as deactivated from the dichotomies that divide it into ought (Sollen) and being (Sein). The conclusions indicate the possibility of a form-of-life and a common use, besides new uses of the law. |
