| Abstract: | O tema-problema na presente dissertação advém da determinaçãolegal de se promover a inculpação do morto para que se configure acapacidade sucessória do cônjuge sobrevivente, separado de fato doautor da herança há mais de dois anos (art. 1.830 do Código Civil). Deoutro lado, na sucessão testamentária, o concubino do testador casado,caso comprove que este, sem culpa sua, está separado de fato docônjuge, há mais de cinco anos, poderá, excepcionalmente, ser nomeado herdeiro ou legatário (art. 1.801, III, Código Civil). O objetivo geral consiste em determinar a legalidade e os efeitos post mortem da culpa na sucessão legítima e testamentária. A hipótese apresentada é de que o critério de culpa previsto no art. 1.801, III e no art. 1830 do Código Civil não é compatível com os sistemas e os objetivos do Direito de Família, do Direito das Sucessões e dos Direitos de Personalidade. |
| Abstract: | The main problem in this dissertation comes from the legaldetermination in promoting the inculpation of the dead to configure thesuccession capacity of the surviving spouse, separated from theinheritance author for more than two years. On the other hand, in thetestamentary succession, the cohabitee of the married testament writer, ifproves that he is separated for more than five years, may, exceptionally,be its heir or legatee. The main objective consists in determining thelegality and the effects of the post mortem in the legitimate andtestamentary succession. The current hypothesis, is that the guilty criteriaforeseen in the art. 1.801, III e no art. 1830 of the civil code is notcompatible with the system and objectives in the Family Law from Right of Successions and Personality. |
