| Abstract: | As situações vivenciadas no conflito da Izidora são as fontes para as fabulações jurídico espaciais da tese, inspirada na ficção científica de China Miéville, A cidade & a cidade. A pesquisa apresenta-se em três partes: o desenvolvimento da matriz jurídico-espacial de contação de estórias; os enredos da Izidora Beszel, da Izidora Ul Qoma e da Izidora Orciny e, ao final, o encontro das estórias nos corpos de Brecha do direito, o planejamento urbano, a judicialização e a negociação do conflito. As fabulações contam estórias sobrepostas em que osdiferentes personagens buscam ocupar o mesmo espaço ao mesmo tempo. Cada enredo, ademais dos pormenores da fábula, pergunta como o direito e o espaço são imaginados, performados e materializados mutuamente, nos acontecimentos. Como ferramenta teórica para desbravar as situações, o materialismo feminista e espacial é elemento chave para construção da matriz (sempre provisória) de mapeamento desta pesquisa. A partir das narrativas, a investigação busca reposicionar as diversas situações jurídico-espaciais no mundo do sensível, combatendo a tendência de despacializar o direito. As diferentes estórias contam, também, sobre os mecanismos de in/visualização entre direito e espaço experimentados nas rupturas e suspensões criadas pelos personagens na mobilização de diversos instrumentos jurídico-espaciais, suas finalidades e fontes. Uma teoria do direito menor é desenvolvida e acompanha as fabulações para pensar sobre os mecanismos de invisibilização da materialidade jurídica em um esforço posicionado: como, onde e porque a despacialização do direito ocorre, quem e o que são afetados? E, ainda, o que o espaço traz para o direito? O devir-minoritário da teoria orienta-se para discussão das escalas e das condições de invisibilização da materialidade no direito, porque (i) são elas que dizem sobre as formas de violência atuais e, ainda, (ii) seu enfrentamento, via rupturas e suspensões, rearranjam os aparatos de negação da vida, reposicionando os corpos e suas situações de produção e reprodução. A experimentação de forma-conteúdo fabulada nas estórias, aparece nos arranjos especulativos jurídico-espaciais que buscam aprender com os eventos e esforçar-se para assumir os pontos de vista dos corpos e de suas situações. Os espaços e os afetos capazes de romper e renegociar os agenciamentos da forma-jurídica hegemônica são experiências provisórias de produção de direitos, em que a multiplicidade entoada se vê sempre ameaçada pela entidade jurídica representada, identitária e proprietária. O devir menor das lutas, irrompendose e refazendo-se jurídico e espacialmente, é também o devir minoritário da experiência do direito e do direito. |
| Abstract: | The situations experienced in Izidoras conflicts are the sources for the spatial-legal fabulation of the thesis, which is inspired by China Miévilles science fiction book "The city & the city". The research is presented in three parts: the development of the spatiallegal matrix of storytelling; the entanglements of Izidora Beszel, Izidora Ul Qoma and Izidora Orciny and, in the end, the encounter of stories in the bodies of Laws Breach, urban planning, judicialization and negotiation of the conflict. The fabulations tell overlapping stories in which the different characters seek to occupy the same space at the same time. Each plot, in addition to the details of the fable, poses the question of how law and space are imagined, performed and materialized mutually in the events. As a theoretical tool to explore situations, feminist and spatial materialism is a key element in the construction of this researchs (always provisional) mapping matrix. The research seeks to reposition the various legal-spatial situations mapped in the sensorial world through the narratives, opposing the tendency to despacialize the law. The different stories also speak of the mechanisms of in/visualization between law and space experienced in the ruptures and suspensions created by the characters as hey mobilize various legal-spatial instruments, their purposes and sources. A minor legal theory is developed in the research and accompanies the fabulations in thinking about the mechanisms of invisibilization of legal materiality in a situated effort: how, where and why does the despatialization of law occur, who and what are affected? And also, what does space bring to the law? The theorys becoming-minor is oriented here to discuss the scales and conditions of materialitys invisibility in the law, because (i) they are the ones that tell of the current forms of violence and, (ii) in confronting them, via ruptures and suspensions, the apparatuses that deny life are rearranged, repositioning the bodies and their contexts of production and reproduction. The experimentation of form-content that is fabled assumes the shape of spatial-legal speculative arrangements that seek to learn from events and strive to take the views of bodies and their situations. The spaces and affections capable of breaking and renegotiating the assemblages of the hegemonic juridical form are provisional experiences of production of rights, in which the multiplicity is always threatened by the majoritarian legal entity, which is marked by representation , identity and property. The becoming-minor of resistance, breaking out and remaking itself legally and spatially, is also the becoming-minor of the experience of the law and the law. |
