Abstract: | O estágio atual do desenvolvimento da tecnologia na área da informática permite que um computador consiga elaborar, em forma de texto, uma resposta a um questionamento realizado, por meio de consulta a banco de dados direcionada por algoritmos e sistemas programados para escolher a resposta mais adequada dentre as diversas alternativas. A presente pesquisa demonstra que essa potencialidade tecnológica pode ser utilizada para o desenvolvimento de sistemas aptos a promover substancial automatização do processo de desenvolvimento do trabalho jurídico forense, notadamente a elaboração de petições e decisões judiciais, com eficiência semelhante ou até superior à do trabalho realizado por um ser humano. Tendo em vista que a maior parte dos novos processos judiciais no Brasil tramitará exclusivamente em sistemas de processo eletrônico e isso facilitará o desenvolvimento de sistemas de automação de tarefas, a disseminação do uso das novas tecnologias terá o potencial de promover uma alteração substancial no sistema judiciário, seja no campo da prática jurídica e da própria ciência do Direito, e também, no mercado de trabalho dos juristas demandando assim a necessidade de estudo e regulamentação da matéria a fim de alinhar o uso da tecnologia aos objetivos do Estado Democrático de Direito. |
Abstract: | The current stage of technology in the field of computer science allows a computer to elaborate, in text format, a response to a question through a database query guided by algorithms and specialist systems programmed to choose the most appropriate response among the various alternatives. This research demonstrates that the technological potential can be used for the development of systems that are capable of promoting substantial automation of the legal work, especially regarding the elaboration of petitions and judicial decisions, with similar or even greater efficiency than the work performed by a human being. In view of the fact that most new court cases in Brazil will be prosecuted in electronic lawsuit systems which facilitates the development of legal automation systems the dissemination of these new technologies has the potential to promote a substantial change in the judicial system, whether in, the field of legal practice or the science of law itself and also in the legal labor market, thus requiring further studies and regulation in order to align the use of technology with the objectives of the Democratic Rule of Law. |
