Abstract: | O presente estudo propõe uma análise das instituições jurídicas adotadas pela legislaçãobrasileira na década de 1990 com o objetivo de garantir independência às agênciasreguladoras de serviços públicos. Essa análise será realizada à luz do objetivo constitucionaldo desenvolvimento nacional e à luz dos marcos conceituais apresentados pelo NovoInstitucionalismo Econômico, cuja premissa é de que as instituições são efetivamente capazesde impactar no desenvolvimento. A hipótese apresentada é a de que a aplicação prática dessasinstituições no Brasil demonstrou, ao longo do tempo, incentivos não-produtivos aodesenvolvimento, cenário que, até o momento, não gerou reformas relevantes para oaprimoramento dessas instituições e de sua capacidade de gerar incentivos produtivos aodesenvolvimento. Em outras palavras, a hipótese é de que essas instituições encontram-se emcircunstância de path-dependency, marcado pela permanência de mecanismos falhos e quenão produzem incentivos ao desenvolvimento. Essa hipótese será avaliada a partir do processode estabelecimento e desenvolvimento das instituições de independência na Agência Nacionalde Telecomunicações - ANATEL e Agência Nacional de Energia Elétrica ANEEL e daanálise dos incentivos gerados ao longo do tempo a partir das constrições legais estabelecidas.A partir dessas avaliações, será comprovada ou refutada a hipótese apresentada, e serãoavaliadas possíveis novas perspectivas para uma reforma do desenho institucional dasagências reguladoras de serviços públicos brasileiras, notadamente no que tange àindependência, tendo como fundamento a busca de incentivos positivos ao desenvolvimentonacional. |
Abstract: | The following study proposes an analysis of the institutions adopted by Brazilian legislationin the 1990s to guaranty the independence of the regulatory agencies of public services. Thisanalysis is going to be based on the constitutional objective of national development and theconceptual frameworks presented by the New Institutional Economics, whose premise is thatinstitutions are effectively capable of affecting development. The hypothesis presented is thatthe application of these institutions in Brazil has demonstrated, over time, severalnonproductive incentives to the development, and that this scenario has not yet generatedrelevant reforms for the improvement of these institutions. That is, the hypothesis is that theseinstitutions have remained in path-dependency, marked by the persistence of failedmechanisms that do not produce incentives for development. This hypothesis will beevaluated from the process of establishment and development of the institutions ofindependence in the Agência Nacional de Telecomunicações - ANATEL and AgênciaNacional de Energia Elétrica ANEEL and from the analysis of the incentives generated overtime from the established legal constrictions. Based on this evaluation, the hypothesispresented will be proven or refuted and there will be presented possible new perspectives onthe institutional design of the Brazilian public service regulatory agencies, based on the searchfor positive incentives for national development . |
