Abstract: | O surgimento e fortalecimento de atores não estatais no comércio internacional desafiam as compreensões clássicas acerca de uma soberania supostamente absoluta. Este trabalho contextualiza o elo evolutivo entre o instituto da soberania e o comércio internacional, demonstrando que sua compreensão é indissociável. Através de uma abordagem interdisciplinar entre teorias do direito internacional, geopolítica e relações internacionais, buscou-se compreender a soberania como um instituto extraterritorial, bem como que seu exercício pode ser desempenhado em quatro diferente regimes: clássico, globalista, imperialista/cooperativo e integrativo, conforme defendido por John Agnew. Após, analisa-se, à luz das teorias de Agnew, em qual regime se encontra o exercício da soberania pelos estados no comércio internacional, sopesando a atuação de atores não estatais, especificadamente da Organização Mundial do Comércio e Organizações Não Governamentais neste cenário. Ao fim, conclui-se que, no que se refere ao exercício da soberania no comércio internacional, atores não estatais seriam responsáveis por adequá-lo ao regime cooperativo. |
Abstract: | The emergence and strengthening of non-state actors in International Trade challenge the classical understandings of supposedly absolute sovereignty. This paper contextualizes the evolutionary link between the institute of sovereignty and International Trade, demonstrating that its understanding is inseparable. Through an interdisciplinary approach between theories of International Law, Geopolitics and International Relations, we sought to understand sovereignty as an extraterritorialinstitute, and that its exercise can be exercised in four different regimes: classical, globalist, imperialist/cooperative and integrative, as advocated by John Agnew. Afterwards, in the light of Agnew's theories, it is analyzed in which regime is the exercise of sovereignty by States in International Trade, analyzing the performance of non-state actors, specifically the World Trade Organization and Non-Governmental Organizations in this scenario. Finally, it is concluded that, with regard to the exercise of sovereignty in international trade, non-state actors would be responsible for adapting it to the cooperative regime. |
