Abstract: | Com a promulgação da Emenda Constitucional n° 125/2022, o sistema de recorribilidade extraordinária sofreu sensível mudança, fomentando o debate sobre o caminho das reformas legislativas nesse âmbito no Processo Civil brasileiro. Urge entender os interesses motivadores das reformas no âmbito dos tribunais superiores, quais estudos e monitoramentos são utilizados como balizas para essas reformas e quais são as efetivas mudanças que a EC 125 trará. Seu objeto é apontar os impactos da aplicação do instituto da relevância como requisito do Recurso Especial a partir da promulgação da Emenda Constitucional n° 125, bem como se essas mudanças são o melhor caminho para as reformas legislativas na recorribilidade extraordinária no Brasil, sob o prisma do Processualismo Constitucional Democrático e do Modelo Constitucional de Processo. |
Abstract: | With the enactment of Constitutional Amendment No. 125/2022, the extraordinary appealability system underwent a significant change, fostering the debate on the path of legislative reforms in this area in the Brazilian Civil Procedure. It is urgent to understand the motivating interests of the reforms within the scope of the superior courts, which studies and monitoring are used as guidelines for these reforms, and what are the effective changes that EC125 will bring aims to point out the impacts of applying the institute of relevance as a requirement of the Special Appeal, from the enactment of Constitutional Amendment n° 125, and whether these changes are the best way for legislative reforms in the extraordinary appealability in Brazil, under the prism of Democratic Constitutional Processulism and the constitutional model of Process. |
