| Abstract: | Esta tese se apoia sobre a integridade do sistema constitucional para deduzir, a partir da interpretação sistemática do seu conteúdo, que propriedade possui um conceito mais abrangente do que o tradicionalmente considerado pelo sistema tributário (renda) e que isso gera implicações definitivas sobre a verificação do confisco e a avaliação da capacidade contributiva dos brasileiros. O confisco tributário ocorre quando a tributação alcança o mínimo existencial, situação em que não existe contributiva. Isso quer dizer que a tributação confiscatória alcança a propriedade privada, abrangendo o acesso a proteção social de contribuintes que não alcançam direitos fundamentais relacionados com a dignidade da pessoa humana. |
| Abstract: | This thesis rests on the integrity of the constitutional system to deduce, from the systematic interpretation of its content, that property has a more comprehensive concept than traditionally considered by the tax system (income) and that this has definitive implications on the assessment of confiscation and the evaluation of the tax-paying capacity of Brazilians. Tax confiscation occurs when taxation reaches the existential minimum, a situation in which there is no capacity to contribute. This means that confiscatory taxation reaches into private property, which includes access to social protection, of taxpayers who do not have access to fundamental rights related to human dignity. |
