| Abstract: | O objetivo do presente trabalho é analisar a crítica cosmopolitista, de fundamento no ser humano, diante do Direito dos Povos do autor norte-americano John Rawls. Inicialmente, apresenta-se uma série de questões de ordem formal. Posteriormente, dá-se início a uma exposição dos conceitos fundamentais da teoria Justice as Fairness de John Rawls. A seguir, apresenta-se ainda o projeto de princípios para o Direito Internacional proposto por Rawls, o chamado Direito dos Povos. O Direito dos Povos é uma tentativa de extrapolar as ferramentas desenvolvidas para a esfera doméstica, para utilização no Justice as Fairness, para a ordem internacional. Os autores que se auto definem como partidários da corrente cosmopolitistas apontam que, apesar de se assemelhar ao livro Uma Teoria da Justiça, o trabalho mais recente de Rawls não possui o mesmo condão |
| Abstract: | The objective of the present study is to analyze the cosmopolitist critique presented to the Law of Peoples envisaged by the American professor John Rawls. First, some questions of formal nature will be addressed. Following this, there is an exposition of the Justice as Fairness theory key concepts. The rawlsian project for international law, Law of the Poples, is then presented. Moreover, several scholars which defend a cosmopolitist stance that believes that even though it shares some similarities with A Theory of Justice, it doesnt holds the same standards for individuality and freedom protection as the former. |
